2. Terms of Sale
Article 1 — Purpose and role of secondsens
secondsens is an online solidarity second-hand shop, published by the non-profit P2P (People To People). Donors (individuals or charities) give the non-profit P2P items they no longer use. P2P resells these items on secondsens and passes on the entire sale proceeds to the solidarity charity chosen by the donor. P2P is the seller of the items offered; the donor receives no money from the sale.
Article 2 — Prices
Prices are shown in euros. The price displayed is the amount due from the buyer. The entire sale proceeds, less only operating costs (online payment and platform), are passed on to the chosen beneficiary charity.
Article 3 — Order and secure payment
Payment is made online through the provider Stripe (Bancontact, bank card, etc.). No banking data is stored by secondsens. P2P collects the sale price as the seller of the items; no amount is collected on behalf of a third party.
Article 4 — Handover and delivery
Items are handed over to the buyer by shipping or by agreed pickup (where applicable at the donor’s place, acting as a simple pickup point). The buyer checks that the item matches the listing at the time of handover.
Article 5 — Refusal at handover / cancellation
If, at the time of handover, the item does not match the listing, the buyer may refuse the transaction. The sale is then cancelled and the buyer is refunded. This check at handover serves as the main guarantee, as these are second-hand items.
Article 6 — Right of withdrawal
Where the law provides for a 14-day right of withdrawal (distance selling), it applies according to the legal terms and the conditions set out on the “Returns and refunds” page. To be clarified with a lawyer depending on the exact nature of the items and any services.
Article 7 — Liability
secondsens reviews listings before publication but cannot guarantee the exact condition of each second-hand item. P2P cannot be held liable for indirect damages related to a transaction.
Article 8 — Payments to charities
The proceeds of each sale are allocated to the cause chosen by the donor. P2P retains 10% of the sale amount to cover operating costs (online payment, platform, logistics) and to support its own activities; the balance is passed on to the designated beneficiary charity. The donation consists of the item given to P2P; the donor receives no money from the sale.
Article 9 — Governing law and disputes
These Terms of Sale are governed by Belgian law. In the event of a dispute, an amicable solution will be sought first; failing that, the courts of the Brussels district have jurisdiction.
